Open Letter to President of Cameroon Paul Biya

Following the appointment of Amsterdam & Partners LLP by Maurice Kamto and the Cameroon Renaissance Movement (CRM), Robert Amsterdam is sending the following open letter to President Paul Biya to put government officials on notice that any violations of human rights of protesters participating in tomorrow’s nationwide marches will result in a full range of legal responses, including the application for potential sanctions against individual government officials.

Excellence Monsieur le Président,

Notre cabinet d’avocats représente le professeur Maurice Kamto, président du Mouvement pour la Renaissance du Cameroun (MRC). Nous vous adressons cette lettre pour vous informer que nous défendrons les droits de M. Kamto et du MRC conformément à la Constitution du Cameroun et au droit international des droits de l’homme.

Comme vous le savez sans doute, des manifestations pacifiques à l’échelle nationale ainsi que des activités de l’opposition sont prévues à compter du 22 septembre 2020. Nous, ainsi que l’ensemble de la communauté internationale, suivrons de près les événements qui se dérouleront en République du Cameroun. Nous nous attendons à ce que ces rassemblements pacifiques, dans l’exercice des droits nationaux et internationaux garantis de liberté d’expression et de réunion, soient autorisés et protégés.

Nous vous informons également de notre intention de demander des comptes aux autorités de la République du Cameroun pour toute violation éventuelle des droits de l’homme, des droits civils et de la sécurité physique du Professeur Kamto, des membres du MRC, et de tous les participants aux manifestations pacifiques et aux activités de l’opposition le 22 Septembre et ultérieurement.

C’est avec une préoccupation particulière que vous avions appris l’arrestation et l’incarcération de M. Kamto en janvier 2019. Celles-ci constituaient une violation flagrante à la fois du droit camerounais et des obligations internationales en matière des droits de l’homme. Nous espérons fortement que ce type d’arrestations et de violations des droits de l’homme ne se reproduira plus.

Notre cabinet d’avocats est prêt et déterminé à protéger les droits de M. Kamto dans toutes les instances juridiques et politiques disponibles. En conséquence, tout responsable de la République du Cameroun qui se livrerait à de telles violations, les autoriseraient ou y consentirait, s’ exposerait à des conséquences graves. Si nous avons connaissance de violations des droits de l’homme commises par des autorités ou en leur nom, nous avons l’intention, de concert avec les autres conseils, de porter plainte auprès des instances juridictionnelles appropriées au niveau national, régional ou international. En outre, nous sommes prêts à plaider en faveur de l’imposition de sanctions économiques et autres, contre les responsables qui violeront droits fondamentaux de M. Kamto.

Je note en particulier que le harcèlement ou les obstructions aux activités pacifiques de l’opposition politique, ainsi que la violation des droits de M. Kamto et des membres du MRC, pourraient entraîner des sanctions ciblées contre des autorités camerounaises en vertu du Global Magnitsky Act des Etats-Unis d’ Amérique et du Global Human Rights Sanctions Regulations du Royaume-Uni. Les personnes ciblées en République du Cameroun désignées dans le cadre de ces programmes de sanctions, pourraient être confrontées à un large éventail de conséquences, notamment le gel de comptes bancaires, la saisie des avoirs détenus à l’étranger et la révocation des visas de voyage pour les personnes désignées et leurs familles.

Nous espérons pouvoir éviter d’en avoir à recourir à de telles actions. Nous supposons que les autorités gouvernementales du Cameroun se conformeront à la fois à la constitution du Cameroun et au droit international afin de respecter les droits du Professeur Kamto, du MRC et des manifestants.

Cela dit, nous, ainsi que l’ensemble de la communauté internationale, suivrons de près la réponse du gouvernement camerounais à l’exercice de la liberté d’expression et de réunion du peuple camerounais le 22 septembre et le traitement qui sera réservé à M. Kamto.

Je vous remercie d’avance de l’attention que vous porterez aux questions soulevées dans cette lettre et de vos efforts pour faire en sorte que les autorités camerounaises respectent et s’assurent du bon respect des droits humains fondamentaux de M. Kamto et du peuple camerounais.

Mr. President, Your Excellency,

This law firm represents Professor Maurice Kamto, President of the Cameroon Renaissance Movement (CRM). We write to inform you that we will advocate for and defend the rights of Mr. Kamto and the CRM to the fullest extent guaranteed in the Constitution of Cameroon and in international human rights law.

As you are undoubtedly aware, peaceful nationwide protests and opposition activities have been planned and will begin on 22 September 2020. We, and the broader international community, will be closely monitoring events in the Republic of Cameroon. We expect these peaceful gatherings in exercise of the domestic and internationally guaranteed rights of freedom of expression and assembly to bed allowed and protected.

We also notify you of our intent to hold accountable all responsible officials of the Republic of Cameroon for any violation of the human rights, civil rights, and physical safety of Professor Kamto, members of the CRM and all those who participate in peaceful protests and opposition activities on September 22 and thereafter. We note with particular concern the arrest and incarceration of Mr. Kamto in January 2019, which was a gross violation of both the law of Cameroon and internationally guaranteed human rights obligations. We fully expect that such arrests and human rights violations will not occur again.

Our law firm is prepared and committed to protecting Mr. Kamto’s rights in the full range of legal and political fora available. As a result, any officials of the Republic of Cameroon who engage in, authorize, or acquiesce in such violations will face severe repercussions. Should we become aware of human rights violations committed by or on behalf of the authorities, it is our intention, along with our co-counsel, to bring legal claims before appropriate national, regional, and international courts. In addition, we are prepared to advocate for the imposition of economic and other sanctions against government officials who violate Mr. Kamto’s basic human rights.

I note in particular that harassment or interference with peaceful political opposition activities and the violation of the rights of Mr. Kamto and members of the CRM could result in sanctions against Cameroonian officials under the Global Magnitsky Act of the United States of America and the United Kingdom’s Global Human Rights Sanctions Regulations. Individuals in the Republic of Cameroon designated under these sanctions programs could face a wide range of consequences, including the freezing of bank accounts, seizures of internationally held assets, and revocations of travel visas for the designated individuals and their families.

We hope and expect such actions will be unnecessary. We assume governmental authorities in Cameroon will comply with both the constitution of Cameroon and international law to respect the rights of Professor Kamto and the CRM. That said, we and the broader international community will be closely monitoring the Government of Cameroon’s response to the exercise of freedom of expression and assembly of the people of Cameroon on September 22nd and the treatment of Mr. Kamto going forward.

I thank you for your consideration of the issues raised in this letter and your efforts to ensure that all authorities in Cameroon respect and uphold the basic human rights of Mr. Kamto and the people of Cameroon.
